Labor & Employment
We represent management in all types of labor and employment litigation and regularly defend our employer clients in lawsuits alleging discrimination, sexual harassment, wrongful termination, "whistle blower," and wage and hour claims. We practice regularly before the NLRB, EEOC, OSHA, Wage & Hour Division of the Department of Labor, and various state Civil Rights Commissions and Workers' Compensation Boards. We also have appeared before all levels of the state, federal, and appellate court systems.
Representative Kahn Kleinman matters are:
- Represent management in all types of labor matters, including negotiating and administrating collective bargaining agreements, labor contract arbitrations, union representation and decertification campaigns and proceedings and related Board litigation
- Counsel to employer clients in developing sound labor relations and employment strategies to comply with the complexities of workplace management within today’s expansion of workers’ rights under state and federal law
- Counseling clients in developing employment and labor relations strategies concerning union resistance, employee discipline and discharge, labor and employment issues affecting the acquisition and sale of businesses, wage and hour practices, layoffs and reductions-in-force, and other sensitive matters, such as employment discrimination, sexual harassment, employee privacy, and workplace drug and alcohol use and testing policies
- Counsel to employers (including human resource departments of large and mid-sized public and private companies, small business owners and entrepreneurs), in drafting employment and severance agreements, and in developing employment policies, employee handbooks, performance appraisal systems, and alternate dispute resolution programs
- Represent employers in litigation before state and federal courts and agencies against claims of age, gender, race, national origin, religious and disability discrimination, as well as claims of wrongful discharge and violations of the Family and Medical Leave Act and the Fair Labor Standards Act
